We exclude liability for any damages arising from the use of the Platform, unless they are due to intentional or grossly negligent behavior on our part. Liability for slight negligence is excluded insofar as this is permissible under Swiss law.
Only persons of legal age (18 years and over) are permitted to use the platform. The user undertakes to provide truthful and complete information when registering and using the platform. Should there be any changes to the personal data, these must be updated immediately.
Users can upload content (e.g. advertisements) to the platform. The user is solely responsible for the accuracy and legality of the content provided by him. Yamino does not systematically review user content, but reserves the right to remove content that violates these GTC or applicable law.
It is prohibited to post illegal, misleading, offensive, discriminatory or otherwise inappropriate content on the platform. Users undertake not to use the platform for fraudulent or misleading activities.
Users may not use the platform for the distribution of spam, fraudulent offers, defamatory content or other illegal activities. It is also prohibited to collect or use information about other users without their express consent.
Communication on Yamino should always be respectful. Insults, discrimination, harassment, or any other inappropriate remarks are prohibited.
Yamino reserves the right to review chat conversations in the event of reports or suspicions to ensure compliance with the platform’s guidelines.
Yamino reserves the right to delete user content and to block user accounts in the event of a breach of these GTC or applicable Swiss law.
The use of the platform is free of charge for buyers and sellers. Yamino reserves the right to introduce fee-based services in the future or to convert existing free services into fee-based services. In such a case, users will be informed in good time and paid services can only be used with the express consent of the user.
By uploading Content to the Platform, the User grants Yamino a royalty-free, non-exclusive, perpetual and worldwide license to use, reproduce and edit such Content in connection with the Platform. The license shall remain in force for archived copies of the content even after the user has deleted the content.
The user warrants that he has the necessary rights to the uploaded content and that it does not infringe the rights of third parties. The user shall indemnify Yamino against any third-party claims arising from the use of his content.
All rights to the Platform, including the content, text, graphics, images, logos and software contained therein, are the property of Yamino or have been legally licensed. The use of the Platform does not grant the user any rights to this content, except for the limited right of use required to use the Platform in accordance with the contract.
Yamino undertakes to treat the personal data of users in accordance with the applicable data protection laws of Switzerland (in particular the Federal Act on Data Protection (FADP)). Further information on data protection and data processing can be found in the privacy policy.
To the extent permitted by law, Yamino excludes any liability for direct or indirect damages arising from the use or non-use of the Platform. This applies in particular to claims relating to the quality or suitability of the goods offered via the platform.
Yamino is not liable for the actions or omissions of users or third parties.
Users are solely responsible for their activities on the Platform. They undertake to indemnify Yamino, its bodies, employees and affiliated companies against all third-party claims arising in connection with a breach of these GTC or applicable law by the user.
Yamino reserves the right to amend these GTC at any time and without prior notice. Continued use of the Platform after the changes come into effect shall be deemed as acceptance of the new T&Cs.
